1. Acceptance of Terms

By accessing, downloading, installing, or using the WNDR platform — including the website at wndrtravel.com and the iOS and Android mobile applications (collectively, the "Service" or "Platform") — you confirm that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and our Content Policy, all of which are incorporated by reference into these Terms.

If you do not agree to any part of these Terms, you must immediately stop using the Service and, if applicable, uninstall the application.

These Terms constitute a legally binding agreement between you (the "User", "you") and WNDR ("WNDR", "we", "us", "our").

We reserve the right to modify these Terms at any time. Material changes will be communicated by email and in-app notification at least 14 days in advance of the effective date. Your continued use of the Service after the effective date of any modification constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.

2. Who We Are

WNDR is a travel social network and community platform operated under the trade name WNDR, accessible at wndrtravel.com and through mobile applications published under the identifiers com.wndrstudio.wndr (iOS) and com.wndr.app (Android).

3. Eligibility

To use WNDR, you must meet all of the following conditions:

• Age: You must be at least 13 years old. If you are between 13 and the age of digital consent in your country (which may be 14, 15, or 16 depending on jurisdiction), you represent that you have obtained verifiable parental or guardian consent before registering.
• Legal capacity: You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are a minor in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.
• Not prohibited: You must not be prohibited from using the Service under any applicable law, regulation, sanction, or embargo.
• No prior ban: You must not have previously had a WNDR account terminated for violation of these Terms.
• Accurate information: All information you provide during registration and thereafter must be accurate, current, and complete.

By registering, you represent and warrant that all of the above conditions are satisfied. WNDR reserves the right to verify eligibility at any time and to suspend or terminate accounts where eligibility cannot be confirmed.

4. Account Registration and Security

By creating a WNDR account, you agree to:

• Provide accurate, current, and complete information during registration and keep it updated
• Maintain the confidentiality of your login credentials and not share your password with any third party
• Not transfer, sell, or assign your account to any other person
• Maintain only one active account at a time — creating multiple accounts to circumvent restrictions or bans is prohibited
• Notify WNDR immediately at [email protected] if you become aware of any unauthorised access to or use of your account
• Be solely and fully responsible for all activity that occurs under your account, whether or not you authorised it, except where caused by WNDR's own failure

WNDR will not be liable for any loss or damage arising from your failure to comply with these account security obligations.

WNDR may, in its sole discretion, refuse to register a username that infringes third-party rights, impersonates a real person or brand, or violates our Content Policy.

5. User Content

5.1 Ownership

You retain full intellectual property ownership of all content you create, upload, or post on WNDR, including photos, videos, text posts, comments, travel plans, blog entries, Q&A contributions, and any other material ("User Content"). These Terms do not transfer any ownership of your content to WNDR.

5.2 Licence Granted to WNDR

By posting User Content on WNDR, you grant WNDR a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, cache, display, reproduce, distribute, transmit, adapt (for technical compatibility), and make available that content, solely for the purposes of:

• Operating, maintaining, and improving the WNDR platform
• Enabling other users to view and interact with your content as you have configured
• Ensuring technical compatibility across devices and formats
• Complying with legal obligations

This licence does not permit WNDR to sell, license, or commercialise your content independently, or to use it for advertising purposes without your separate explicit consent. This licence terminates when you delete the content or your account, subject to reasonable CDN cache clearance delays (up to 30 days) and any content that other users have lawfully shared or archived.

5.3 Representations and Warranties

By posting User Content, you represent and warrant that:

• You own or have all necessary rights, licences, consents, and permissions to post the content
• Posting the content does not violate or infringe any third-party rights, including copyright, trademark, privacy, personality rights, or any other intellectual property or proprietary rights
• The content complies with these Terms and our Content Policy
• You have obtained consent from any identifiable persons depicted in photos or videos before posting such content
• The content does not contain false, misleading, or deceptive information
• The content does not contain malware, viruses, or any code designed to cause harm

5.4 Content Moderation

WNDR reserves the right — but not the obligation — to review, moderate, remove, or disable access to any User Content at our sole discretion, without prior notice, for any reason including but not limited to violation of these Terms or our Content Policy. Removal of content does not constitute a waiver of WNDR's right to take further action.

5.5 Feedback

If you submit suggestions, ideas, or feedback about WNDR ("Feedback"), you grant WNDR a perpetual, irrevocable, royalty-free right to use, incorporate, and act on that Feedback without obligation to you.

6. Prohibited Conduct

In addition to compliance with our Content Policy, you expressly agree not to:

• Use the Service to harass, bully, stalk, threaten, intimidate, or discriminate against any person or group
• Post content that is illegal, harmful, abusive, or violates our Content Policy
• Create a false identity, impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use automated tools (bots, scrapers, crawlers, spiders) to access, collect, or extract data from the Service without our express written permission
• Attempt to gain unauthorised access to any part of the Service, other users' accounts, or our backend systems
• Interfere with, disrupt, or degrade the integrity, performance, or security of the Service
• Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service
• Use the Service for any commercial purpose without WNDR's express prior written consent
• Sell, transfer, sublicense, or monetise your WNDR account
• Circumvent, disable, or tamper with any technical measures or security features of the Service
• Post or transmit any content containing viruses, malware, ransomware, or any other malicious code
• Use the Service to collect other users' personal data without their consent
• Engage in any activity that violates applicable local, national, or international law or regulation
• Use the Service to promote, facilitate, or engage in pyramid schemes, multi-level marketing, phishing, or any other fraudulent activity
• Attempt to overload or deny service to the platform through denial-of-service attacks or similar techniques

Violation of these prohibitions may result in immediate account termination and, where applicable, reporting to law enforcement.

7. Platform Features: Specific Terms

7.1 Social Feed, Posts, and Interactions

The WNDR social feed, country/city pages, and associated features (posts, comments, likes, tags, follows) are provided for community interaction around travel. You are solely responsible for your interactions with other users. WNDR does not facilitate offline meetings and is not responsible for any harm arising from user interactions on or off the platform.

7.2 Buddy Finder

The Buddy Finder feature suggests potentially compatible travel companions based on your voluntarily provided profile data. Use of Buddy Finder is entirely optional. WNDR makes no representation or warranty as to the accuracy, suitability, safety, or reliability of any match. You are solely responsible for exercising your own judgement when engaging with matched users, both online and offline. WNDR is not liable for any harm, loss, or damage arising from interactions facilitated by Buddy Finder. Always follow basic personal safety precautions when meeting people you have connected with online.

7.3 Country and City Pages

Country and city pages contain a mix of user-generated content and general information. WNDR does not guarantee the accuracy, completeness, or currency of any information on these pages. Travel information changes frequently; always verify critical travel details (entry requirements, safety, health advisories) with official government sources before travelling.

7.4 Virtual Tours

Virtual Tours link to embedded Google Maps Street View content. WNDR does not own, control, or maintain this content. Street View imagery may be outdated and should not be relied upon for safety-critical decisions.

7.5 Q&A Sections

Q&A content on country and city pages is entirely user-generated. WNDR does not verify, endorse, or guarantee the accuracy of any answer. You rely on this information at your own risk.

7.6 Rankings and Achievements

Rankings and achievement systems are based on data you provide about countries visited. WNDR does not independently verify claims. Rankings are for entertainment and community purposes only and have no legal or commercial value.

7.7 Group Chats

Group chat features are subject to our Content Policy. Group administrators (where applicable) are responsible for maintaining their groups in compliance with these Terms. WNDR may dissolve groups that violate our policies without notice.

7.8 Traveling Tools

The Traveling Tools section provides general informational content about travel-related topics (money, safety, communication, planning, etc.). This information is provided for general informational purposes only and does not constitute professional advice (legal, medical, financial, or otherwise). Always consult appropriate professionals and official government sources for critical travel decisions.

8. Paid Services — Trip Planning

WNDR offers a bespoke travel itinerary design service ("Trip Planning") subject to availability. This service is currently offered as a limited-capacity service.

8.1 Service Description

Upon purchase and confirmation, WNDR will prepare a customised travel itinerary based on the preferences and requirements you specify at the time of booking.

8.2 Pricing and Payment

• The fee is displayed at the time of booking and charged in full upon confirmation
• Prices include applicable VAT where required by law
• All payments are processed securely by Stripe, Inc. WNDR does not store your payment details
• By making a payment, you also agree to Stripe's Terms of Service
• Your booking is confirmed upon receipt of full payment and a confirmation email

8.3 Delivery

• Itineraries will be delivered within 5–7 business days of confirmed payment
• One free revision round is included per itinerary, submitted within 14 days of delivery
• Delivery is made by email to your registered address

8.4 Refunds

• The service fee is non-refundable once the itinerary has been delivered
• If WNDR is unable to deliver the itinerary within the agreed timeframe due to reasons within our control, a full refund will be issued within 14 business days
• EU/EEA consumers: you have a statutory 14-day right of withdrawal from the date of purchase, except where you have expressly requested that delivery begin within the withdrawal period. By requesting delivery to begin immediately, you acknowledge the right of withdrawal is waived upon delivery
• Nothing in this section limits or excludes statutory rights you may have under applicable consumer protection law

8.5 Nature of the Service

Trip Planning itineraries are provided as general travel suggestions only. WNDR does not guarantee the availability, pricing, safety, or suitability of any recommended services, accommodations, or experiences. You are solely responsible for verifying all details and making your own bookings.

9. WNDR Shop

WNDR operates an online merchandise shop ("WNDR Shop") offering branded travel apparel and accessories produced through a print-on-demand model. The Shop is currently inactive and will be subject to separate terms when activated, which will be communicated in advance.

When active, the following terms will apply:

• Products are manufactured by third-party print-on-demand suppliers. WNDR does not hold inventory.
• Production and delivery timescales, returns, and refund terms will be clearly stated at the time of purchase.
• EU/EEA consumer statutory rights, including the right of withdrawal for distance contracts, will apply where applicable.
• WNDR is the seller of record for all Shop transactions.

10. Affiliate and Booking Links

The WNDR "Reservations" section provides links to third-party booking platforms (including Booking.com, Skyscanner, GetYourGuide, and Discovercars). These are provided for user convenience and may be affiliate or referral links through which WNDR may receive a commission if you make a booking, at no additional cost to you.

• WNDR does not control, operate, or take responsibility for third-party platforms or the services they provide
• Your booking contracts are with the relevant third-party service provider, not with WNDR
• WNDR does not guarantee price accuracy, availability, or the quality of any third-party service
• Any disputes regarding bookings made through third-party platforms must be resolved directly with that platform
• WNDR's receipt of affiliate commissions does not influence the availability or selection of featured platforms

11. Third-Party Services and Links

The Service contains links to, and integrations with, third-party websites, applications, and services. WNDR provides these for user convenience only and does not endorse, control, or accept responsibility for:

• The content, accuracy, or practices of any third-party service
• The privacy practices of any third-party service
• The availability or reliability of any third-party service

Your use of any third-party service is at your own risk and governed by that service's own terms and privacy policy.

12. Intellectual Property

All WNDR platform content that is not User Content — including but not limited to the interface design, layout, logos, trademarks, graphics, icons, software, source code, and underlying technology — is owned by or licensed to WNDR and protected by applicable Spanish and international intellectual property law, including:

• Real Decreto Legislativo 1/1996 (Ley de Propiedad Intelectual)
• Ley 17/2001 de Marcas
• EU Directive 2019/790 on Copyright in the Digital Single Market
• Applicable copyright, trademark, and trade secret laws in other jurisdictions

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or exploit any part of the WNDR platform without our express prior written permission, except as expressly permitted by these Terms.

The WNDR name, logo, and branding are trademarks of WNDR. Nothing in these Terms grants you any right to use WNDR's trademarks.

If you believe your copyright has been infringed on the WNDR platform, please contact [email protected] with a detailed notice.

13. Account Suspension and Termination

13.1 Termination by WNDR

WNDR may suspend, restrict access to, or permanently terminate your account and your access to the Service, with or without prior notice, for reasons including but not limited to:

• Violation of these Terms, our Content Policy, or any applicable law
• Harmful, abusive, fraudulent, or illegal activity
• Providing false information during registration
• Actions that harm other users, third parties, or the integrity of the platform
• Extended account inactivity exceeding 24 consecutive months (with at least 30 days' prior email notice)
• At our sole discretion, for any reason not prohibited by applicable law

13.2 Consequences of Termination

Upon termination of your account:

• Your access to the Service will immediately cease
• Your profile and User Content will be deleted in accordance with our Privacy Policy
• You remain bound by provisions of these Terms that by their nature should survive termination, including Sections 5.2, 12, 15, 16, and 18
• Any unpaid amounts owed to WNDR remain due

13.3 Termination by You

You may terminate your account and these Terms at any time by deleting your account via Settings → Account → Delete Account, or by contacting [email protected]. Termination does not entitle you to a refund of any amounts paid for services already rendered.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE
• WNDR EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY
• WNDR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WNDR DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY USER-GENERATED CONTENT OR ANY INFORMATION PROVIDED THROUGH THE SERVICE
• ANY CONTENT DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICE IS ACCESSED AT YOUR OWN RISK

Nothing in this section affects any statutory rights you may have as a consumer under applicable EU or national law that cannot be excluded or limited.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WNDR SHALL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES
• LOSS OR CORRUPTION OF DATA OR CONTENT
• COST OF SUBSTITUTE SERVICES
• DAMAGES ARISING FROM YOUR RELIANCE ON INFORMATION OR CONTENT OBTAINED THROUGH THE SERVICE
• DAMAGES ARISING FROM INTERACTIONS WITH OTHER USERS, WHETHER ONLINE OR OFFLINE
• DAMAGES ARISING FROM THIRD-PARTY SERVICES, PLATFORMS, OR CONTENT LINKED FROM THE SERVICE

WNDR's total aggregate liability to you for all claims arising from or related to the Service shall not exceed the greater of: (a) the total amount paid by you to WNDR in the 12 months immediately preceding the event giving rise to the claim, or (b) EUR 100.

Nothing in these Terms limits or excludes WNDR's liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under applicable mandatory consumer protection law (including EU Directive 2011/83/EU and Spanish Real Decreto Legislativo 1/2007)
• Any other liability that cannot be excluded or limited by applicable law

16. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless WNDR and its officers, directors, employees, agents, contractors, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and costs) arising from or related to:

• Your use of or access to the Service
• Your User Content
• Your violation of these Terms or our Content Policy
• Your violation of any third-party right, including intellectual property, privacy, or personality rights
• Your violation of any applicable law or regulation
• Any claim by a third party arising from your interactions with them through or facilitated by the Service

This indemnification obligation does not apply to the extent that any claim arises from WNDR's own negligence, fraud, or breach of these Terms.

17. Force Majeure

WNDR shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from circumstances beyond WNDR's reasonable control, including but not limited to:

• Natural disasters, acts of God, fires, floods, earthquakes, or extreme weather events
• War, armed conflict, terrorism, civil unrest, or government action
• Pandemics, epidemics, or public health emergencies
• Telecommunications or internet infrastructure failures not within WNDR's control
• Third-party service provider outages (including cloud hosting, CDN, or payment providers)
• Cyberattacks, distributed denial-of-service attacks, or other malicious acts by third parties
• Changes in applicable law or regulation that make performance impossible or unlawful

In the event of a force majeure event, WNDR will notify users as soon as reasonably practicable and take reasonable steps to resume normal service. If a force majeure event affecting paid services persists for more than 30 days, affected users will be entitled to a pro-rata refund for the period of unavailability.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions, and to the extent applicable, EU law.

18.2 Jurisdiction

Any dispute, claim, or controversy arising out of or in connection with these Terms or your use of the Service that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Madrid, Spain.

18.3 EU Consumer Rights

If you are a consumer residing in the EU, you benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your right to rely on such provisions. EU consumers may also access the European Commission's Online Dispute Resolution (ODR) platform for unresolved disputes. WNDR's contact for ODR purposes is [email protected].

18.4 Informal Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at [email protected] to seek an informal resolution. We commit to responding to good-faith complaints within 15 business days.

19. General Provisions

• Entire Agreement: These Terms, together with the Privacy Policy and Content Policy, constitute the entire agreement between you and WNDR with respect to the Service and supersede all prior agreements and understandings
• Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect
• Waiver: WNDR's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.
• Assignment: You may not assign or transfer any of your rights or obligations under these Terms without WNDR's prior written consent. WNDR may assign these Terms, in whole or in part, to a successor in connection with a merger, acquisition, or sale of assets, subject to the notice requirements in our Privacy Policy.
• No Partnership: Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchisee relationship between you and WNDR.
• Language: These Terms are drafted in English. Translations may be provided for convenience. In the event of any conflict or inconsistency between the English version and any translation, the English version shall prevail.
• Notices: Legal notices to WNDR must be sent to [email protected]. WNDR may send notices to you at the email address associated with your account.
• Headings: Section headings in these Terms are for convenience only and have no legal effect.
