2. Purpose and Scope

This Legal Notice governs access to and use of the WNDR platform, including the website at wndrtravel.com and the iOS and Android mobile applications. It should be read alongside our Terms of Service, Privacy Policy, Content Policy, and Cookie Policy, all of which form part of the legal framework governing use of WNDR.

By accessing or using WNDR, you confirm that you have read and agree to be bound by all of the above documents.

3. Intellectual Property

All original WNDR platform content — including the interface design, layout, logos, trademarks, graphics, icons, software architecture, and source code — is owned by or licensed to WNDR and is protected under Spanish and international intellectual property law, including:

• Real Decreto Legislativo 1/1996, of 12 April, approving the revised text of the Intellectual Property Law (Ley de Propiedad Intelectual)
• Ley 17/2001, of 7 December, on Trademarks (Ley de Marcas)
• EU Directive 2019/790 on Copyright and Related Rights in the Digital Single Market
• Applicable copyright, trademark, design right, and database right protection in other jurisdictions

User-generated content remains the intellectual property of the respective users who created it. By uploading content, users grant WNDR a limited licence to host and display it as set out in our Terms of Service. This does not transfer ownership.

Unauthorised reproduction, distribution, modification, public communication, or any other exploitation of WNDR platform content without express prior written permission is strictly prohibited and may give rise to civil and criminal liability under applicable law.

4. Nature of Service — Intermediary Provider

WNDR operates as an intermediary information society service provider within the meaning of EU Regulation 2022/2065 (Digital Services Act), Spanish Law 34/2002 (LSSI-CE), and EU Directive 2000/31/EC (e-Commerce Directive).

As an intermediary provider:

• WNDR is not the author or originator of user-generated content and is not responsible for its accuracy, legality, or appropriateness
• WNDR does not have a general obligation to monitor all user-generated content proactively
• WNDR will act promptly to remove or disable access to illegal or violating content upon receiving proper notification (see Section 6)
• WNDR maintains a proportionate notice-and-action system in compliance with applicable law

Limitation of liability for intermediary providers as set out in the DSA, LSSI-CE, and equivalent applicable law applies to the extent that WNDR fulfils the conditions set out therein.

5. Limitation of Liability

WNDR shall not be liable for:

• The content, accuracy, completeness, or lawfulness of user-generated content
• Technical failures, interruptions, or unavailability of the Service
• Data loss caused by circumstances beyond WNDR's reasonable control
• Damages arising from your reliance on information provided through the platform
• Actions or content of third-party services linked from or integrated with WNDR
• Consequences of events of force majeure

WNDR's liability is further limited and qualified as set out in Section 15 of our Terms of Service. Nothing in this Legal Notice limits liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by applicable law.

6. Notice and Takedown — Copyright and Illegal Content

If you believe any content on WNDR infringes your rights or is illegal under applicable law, you may submit a notice to us at [email protected].

For copyright infringement notices, your notice must include:

• Your full name and contact details (email and, where applicable, postal address)
• A clear description of the copyrighted work you claim has been infringed
• The specific URL(s) of the allegedly infringing content on wndrtravel.com
• A good-faith statement that the use is not authorised by the rights holder, their agent, or the law
• A statement, under penalty of perjury (where applicable), that you are the rights holder or are authorised to act on their behalf
• Your electronic or physical signature

For notices of illegal content (other than copyright), include a description of the content, its URL, the specific law(s) you believe it violates, and your contact details.

We will acknowledge receipt and respond within 10 business days. Manifestly unfounded or abusive notices may themselves give rise to liability.

Counter-notices: if your content was removed following a notice you believe was incorrect or submitted in bad faith, you may submit a counter-notice to [email protected] with the information required by applicable law. We will process counter-notices in accordance with our obligations under the DSA and applicable national law.

7. External Links and Third-Party Content

WNDR contains links to third-party websites and services, including booking platforms (Booking.com, Skyscanner, GetYourGuide, Discovercars), Google Maps (Virtual Tours), and other external resources. These links are provided for informational and functional purposes.

WNDR does not control, endorse, verify, or accept responsibility for:

• The content, accuracy, or availability of any third-party website or service
• The privacy practices or data processing of any third-party service
• Any products, services, or transactions offered by third parties

Your interactions with third-party websites are governed entirely by their own terms and privacy policies.

8. Applicable Law and Jurisdiction

This Legal Notice is governed by the laws of Spain, including:

• Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE)
• EU Regulation 2016/679 (GDPR)
• Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (LOPDGDD)
• EU Regulation 2022/2065 (Digital Services Act)
• Real Decreto Legislativo 1/2007 (Ley General para la Defensa de los Consumidores y Usuarios)

Any disputes arising from this Legal Notice shall be submitted to the competent courts of Madrid, Spain, subject to applicable mandatory provisions of EU and national consumer protection law that may confer jurisdiction on other courts for consumer disputes.

9. Digital Services Act (DSA) — Transparency Information

WNDR is subject to EU Regulation 2022/2065 (Digital Services Act) as an intermediary service provider. In accordance with DSA obligations:

• WNDR maintains a transparent notice-and-action mechanism (see Section 6 above and our Content Policy)
• WNDR maintains records of content moderation actions and decisions
• Users subject to moderation actions have access to an internal appeals process (see our Content Policy, Section 14)
• WNDR does not use recommender systems based on profiling for content ranking at this time
• WNDR does not serve targeted advertising based on user profiling
• WNDR does not knowingly serve advertising to users known to be under 18

As a platform currently below the DSA "Very Large Online Platform" threshold, WNDR's DSA obligations are those applicable to standard online platforms. This section will be updated as the platform grows or as regulatory requirements change.
