Terms of Service

1. Acceptance of Terms

By accessing or using the WNDR platform — including the website at wndrtravel.com and the iOS and Android mobile applications (collectively, the "Service") — you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and WNDR ("WNDR", "we", "us", "our"), a registered trade name operating the platform.

We reserve the right to modify these Terms at any time. Material changes will be communicated at least 14 days in advance. Continued use after changes take effect constitutes acceptance.

2. Eligibility

To use WNDR, you must:

• Be at least 16 years old
• Have the legal capacity to enter into a binding agreement under applicable law
• Not be prohibited from using the Service under applicable law
• Not have had a WNDR account previously terminated for violations of these Terms

By registering, you represent and warrant that all conditions above are met and that the information you provide is accurate, current, and complete.

3. Account Registration and Security

You agree to:

• Provide accurate, current, and complete registration information
• Keep your login credentials confidential and not share them with any third party
• Notify WNDR immediately at [email protected] of any unauthorized access to your account
• Be solely responsible for all activity under your account
• Maintain only one account — multiple accounts to circumvent restrictions are prohibited

WNDR will not be liable for any loss or damage resulting from your failure to comply with these security obligations.

4. User Content

4.1 Ownership

You retain full intellectual property ownership of all content you create and post on WNDR, including photos, text, travel plans, videos, and comments ("User Content").

4.2 License granted to WNDR

By posting User Content, you grant WNDR a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, display, reproduce, distribute, and transmit that content solely for the purpose of operating, improving, and promoting the WNDR platform. This license terminates when you delete the content or your account, subject to reasonable technical delays.

4.3 Representations and warranties

By posting User Content, you represent and warrant that:

• You own or have all necessary rights and licenses to the content
• Posting does not violate any third-party rights (copyright, trademark, privacy, etc.)
• The content complies with these Terms and our Content Policy
• The content does not contain false or misleading information

4.4 Content moderation

WNDR reserves the right — but has no obligation — to review, remove, or disable access to any User Content at our sole discretion, without prior notice, for any reason including violation of these Terms.

5. Prohibited Conduct

You expressly agree not to:

• Harass, bully, stalk, threaten, intimidate, or discriminate against any person
• Post content that is illegal, harmful, abusive, or in violation of our Content Policy
• Use bots, scrapers, or automated tools to access or extract data from the Service
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Interfere with or disrupt the integrity, performance, or security of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any commercial purpose without WNDR's express written consent
• Sell, transfer, or sublicense your account
• Circumvent any technical measures protecting the Service
• Violate any applicable local, national, or international law or regulation

6. Paid Services

6.1 Trip Planning Service

WNDR offers a custom travel itinerary design service ("Trip Planning") for a one-time fee per itinerary. By purchasing:

• The fee is displayed at the time of booking and charged in full upon confirmation
• Custom itinerary delivered within 5–7 business days of confirmed payment
• One free revision round is included per itinerary
• Non-refundable once the itinerary has been delivered, except as required by applicable consumer protection law
• If WNDR cannot deliver within the agreed timeframe through no fault of the user, a full refund will be issued

6.2 Payments and billing

All payments are processed securely by Stripe, Inc. WNDR does not store or access your full payment card details. By making a payment, you also agree to Stripe's Terms of Service. All prices are displayed inclusive of applicable VAT where required by law.

6.3 Affiliate and referral links

WNDR includes links to third-party booking platforms (hotels, flights, experiences, car rental) through affiliate partnerships. WNDR may earn a commission when you click these links and make a purchase, at no additional cost to you. WNDR does not control, guarantee, or take responsibility for third-party services.

6.4 Consumer rights (EU/Spain)

If you are a consumer resident in the European Union, you may have additional rights under applicable consumer protection law. These rights are not excluded or limited by these Terms.

7. Intellectual Property

All WNDR platform content — interface design, layout, graphics, logos, software, and source code — is owned by or licensed to WNDR and protected by Spanish and international intellectual property law. Unauthorized reproduction or distribution without express prior written permission is strictly prohibited. If you believe your copyright has been infringed, contact [email protected].

8. Third-Party Services and Links

The Service may contain links to third-party websites and services. WNDR does not control, endorse, or accept responsibility for any third-party content, privacy practices, or availability. Your use of third-party services is at your own risk and governed by their respective terms.

9. Account Suspension and Termination

WNDR may suspend, restrict, or permanently terminate your account, without prior notice, for violation of these Terms, harmful conduct, fraudulent or illegal activity, or extended inactivity (more than 24 months, with prior email notice). You may delete your account at any time from the app. Sections 4.2, 7, 11, 12, and 13 survive termination.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WNDR does not warrant that the Service will be uninterrupted, error-free, or that any user content is accurate, reliable, or suitable for any purpose.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WNDR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

WNDR's total aggregate liability for any claims shall not exceed the greater of: (a) the total amount paid by you to WNDR in the 12 months preceding the claim, or (b) EUR 100.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law, including EU consumer protection law.

12. Indemnification

You agree to defend, indemnify, and hold harmless WNDR from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain. Any dispute shall be submitted to the exclusive jurisdiction of the competent courts of Madrid, Spain.

14. General Provisions

• Entire agreement: These Terms, Privacy Policy, and Content Policy constitute the entire agreement between you and WNDR
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force
• Waiver: WNDR's failure to enforce any right is not a waiver of that right
• Assignment: You may not assign your rights without WNDR's prior written consent
• Language: These Terms are drafted in English. In case of conflict with a translated version, the English version prevails
